H.R. 2887 - National EVERIFY bill
NOTE: The following is information about the national everify bill. The action alerts are null and void since this bill DOES NOT LOOK like it will make it to the House floor for debate and vote this year. Clearly this bill was controversial between Enforcement groups because of the states preemption language.

Word has it that TX Louie Gohmert, TX Ted Poe and PA Tom Marino had committed to vote FOR the Amendment taking the language out - but they voted AGAINST it. The Amendment vote... was 16 - 18
The ADVANCING of the bill WITH THE PREEMPTION LANGUAGE was 22-13. Why did the DEMS introduce the amendment and vote FOR it? Because they figured Boehner would NOT mark up the bill if the preemption language was in it - equal to killing the bill. NOW the bill advances to the House floor and it's up to Boehner for a closed rule (meaning no amendments will be allowed) Which is likely. An Open Rule means amendments will be allowed - unlikely to happen. Boehner is questionable. TX - Lamar Smith while introducing the bill ALSO introduced an AG bill that allowed 500,000 immigrant visas. AZ Benjamin Quayle is a McCainite - hoping to take McCain's place when he retires. So there are plenty of snakes in the woodpile.The reason many conservative activists were willing to push the bill through with the preemption language is for the states who will NOT pass Everify laws. For instance CA has many local Everify requirements but they can't get anything passed at the State level. Unfortunately they are willing to screw the other 25 states who have passed some form of EVERIFY. What they fail to realize is that

Federal EVERIFY bill passed the Judiciary Committee today WITH THE STATES PREMPTION language. Now, I've got plenty to say about this fiasco and NUMBERS USA "poison pill" and "open borders" comments and role in this debaucle. Please withdraw your support of donations and remove your name from NumbersUSA. Here is the comment I posted on their FB page - Unbelievable. The only reason it passed the Committee was because the State's PREEMPTION language was in it. Funny this bill was introduced 3 weeks after the Supreme Court upheld AZ SB1070 Everify section. Does anyone other than NumbersUSA believe that BO's administration will enforce this law? After the Ice John Morton Memo and Napolitanos Dept. of Homeland Security DreamAct Policy? THESE PEOPLE do not want state's to have the right to enforce the laws because they know the states will be AGRESSIVE in getting the job done. How sad and how shameful it is of NumbersUSA to mislead and beguile citizens into thinking this language was okay? I'm very disappointed that Roy Beck repeatedly aligned those of us who opposed the language as being in cahouts with the "Open Borders" crowd. When you have the "fathers", the "experts" on opposing illegal immigration and enforcing our laws like Kris Kobach, Lou Barletta, and Daryl Metcalfe saying REMOVE THE PREEMPTION LANGUAGE - it's a pretty safe bet they know what they are talking about! I am withdrawing support of this compromised organization.

If the state preemption is signed into law it will represent the biggest setback in immigration enforcement since the corrupt and failed IRCA Amnesty of 1986.The state preemption, Section 6 is exactly the same in the new bill, HR2885, as in the previous bill. It has not been removed.

In addition to the state preemption, which open borders activists love, HR2885 has other problems.
The type of documents that can be used to establish work eligibilty have been expanded in HR2885 beyond the I-94 and I-94A to whatever documents "the Secretary" designates. page 4
Fraud Prevention, Section 10 (page 62), has been reduced with the removal of Section C from HR2164. We need more fraud prevention, not less.
The Biometric Pilot Plan that was described in detail in HR2164 has been reduced from seven pages to just one paragraph in HR2885, Section 11 (last page) , which could lead to potential abuses.
There is no reason for the states to be preempted from passing and enforcing their own E-Verify laws, none.

The White House Blog announcement on Aug. 19th, which is in effect an amnesty based on the Morton Memo.
Dept of Labor Sec. Hilda Solis announcing that the DOL would be helping illegal aliens and then went on to call deportation as abuse in the workplace
Section 6 - Preemption MUST be removed from this bill or we will have no workplace enforcement in the country. Currently 17 states have their own E-Verify laws in one form or another. With the Supreme Court ruling that Arizona's E-Verify law is legal, by next year we could have 25 - 30 states passing their own laws, especially as illegal alien crime continues to soar in communities and voters begin to demand action from local governments.
