Please OPPOSE LB192 Sex Education is NOT the responsibility of the educational system. Please OPPOSE LB313 This is just one more NANNY type of legislation. Sounds like this could affect one who may not be at a school function but simply passing by on the sidewalk that happens to coincide with a school function/event. I'm not interested in paying school personnel to be on tobacco duty.  Really with the millions of dollars worth of drugs caught at our borders and inside our country on a daily basis - you are worried about a product that is legal?

Please OPPOSE 204 This bill adds an unnecessary burden to taxpayers and parents. Especially when those in low risk areas will be required to pay $17.65 per child. For a family of four that would be $80 dollars while those who are low-income get the testing for "free"..well free to them but costing the taxpayers.

LB313 Nordquist Adopt the Tobacco-Free Schools Act and change school accreditation provisions......Visitor means any person on school property or at an off-campus school-sponsored event....Off-campus school-sponsored event means an event sponsored by a school or school district that is not on school property, including, but not limited to, a sporting event, a day camp, a field trip, an entertainment seminar, a dance, or a theatrical production...

LB204 Council Require blood-lead testing prior to enrollment in school. COSTS BY TAXPAYERS/ALSO NO OPT OUT OPTION: The bill provides for the cost of blood lead testing is to be borne by families except in the case of children whose parents or guardians are financially unable to meet such cost. The bill does not define when a parent is financially unable to meet the cost. It is assumed that tests for children who are on Medicaid and Chip will be paid by HHS...HHS also assumes children who are eligible for the Vaccines for Children, a federally funded and state-operated vaccine supply program, will also qualify to have the cost of blood tests paid by HHS. Statistics from HHS show a total of 147,000 children were Medicaid eligible or in the CHIP program in 2010 which is approximately 44% of total student membership. There are about 25,000 children entering kindergarten on an annual basis. HHS indicates the department currently pays for blood testing to determine lead levels for about 2,740 children. The cost of a lab test is $17.65. It is assumed that blood lead tests for 8,300 children will be covered by HHS pursuant to the bill based upon: 25,000 kids inkindergarten each year x 44%, minus the number of tests currently being paid for by HHS. This is the estimated number of children on Medicaid or in CHIP that will be tested annually pursuant to the bill. The estimated fiscal impact for lab tests is $146,495 ($51,273 General, $95,224 Federal) to test 8,300 children in FY 2011-12 and FY 2012-13. As noted above, HHS indicates there may be some non-Medicaid eligible children who could be eligible to have their costs paid, if children in the Vaccines for Children program are included. This would add about 4,400 children at a general fund cost of $77,660.The fiscal impact is based upon assuming that medical personnel will not sign statements allowing children to opt out of testing. HHS assumes that medical personnel will not sign a statement verifying that children are at low risk due to the stringent requirements in the bill to verify such status.

In 2007, a 21 year-old woman was vacationing at a resort in the Bahamas when she decided to ride on a Jet Ski, the most widely-used personal watercraft. Unfortunately, she slipped off the back of the watercraft and was eviscerated by the high-pressure stream of water that powers the vehicle. She suffered serious permanent injuries to the vagina, anus and rectum.

Through the years, a number of men and women have suffered similar injuries to the groin and abdominal area – one of the least publicized dangers in the recreational boating industry. During the 1980s, a 16 year-old male riding as a passenger in France fell behind the jet nozzle while the watercraft was jumping a wave. He suffered a severe rectal injury that resulted in death. In 1990, the jet stream from a personal watercraft ripped open the vagina of a 17 year-old woman who was riding as a passenger. She survived after receiving prompt medical attention to stop the bleeding.

Because these types of abdominal accidents have received little attention from the media, most owners and operators of personal watercraft are unaware of the risk of death or permanent injury. Certainly, the danger of falling backwards directly into the jet stream never seems to be mentioned when vacationers rent a watercraft at a U.S. or international resort. Instead, the water sports rental company will typically recommend wearing a flotation device, a wet suit or protective clothing – an unlikely option in warm-weather vacation destinations. Then, the rental agent will caution the operator to drive safely and avoid high speeds, tight turns and wave-jumping maneuvers. Shortly thereafter, the operator usually races away from the dock and starts maneuvering the craft without the benefit of training or supervision.

Policy Statement: Personal Watercraft Use by Children and Adolescents. Pediatrics. 2000;105(2):452–453. Reaffirmed June 2010 www.aapublications.org ....According to the National Electronic Injury Surveillance System data, 7% of injuries occurred to children 14 years and younger; 38% of those injured were 15 to 24 years old.1 In the National Transportation Safety Board study, 9% of operators involved in PWC incidents were younger than 16 years, and 46% were 16 through 24 years old.2 Finally, in the report by Hamman et al,7 27% of the injured were younger than 17 years, and 61% were 25 years of age or younger. In an even more telling set of statistics, in California, children younger than 18 years accounted for 14% of all boating incidents, 18% of all boating injuries, and 5% of boating fatalities, but 93% of these incidents involved PWC.8 Conversely, PWC in California represented 16% of all registered vessels but accounted for 55% of all boating injuries.2HYPERLINK \l "B8",8   PWC are the only recreational boats for which the leading cause of death is not drowning; most fatalities result from blunt trauma. When the cause of death is drowning, most victims are not wearing personal flotation devices. The types of nonfatal injury are quite varied. Lacerations represent 30% to 57% of the injuries. There are 3 case reports of significant vaginal laceration while riding a PWC.4-6 Fractures are the next most commonly recorded injury (12% to 26%). The lower extremity is injured more commonly than is the upper extremity. Branche et al1 and Hamman et al7 report a significant incidence of head injury (17% to 29%)....

LB165 Fischer Revenue Committee - Adopt the Nebraska Municipal Telecommunications Service Occupation Tax Act The purpose of LB165 is to phase out the ability of municipalities to impose an occupation tax on telecommunications services by 2018. From the effective date of the act through 2017, the bill limits existing occupation taxes to telecommunications services; equipment will not be taxed. If a municipality wants to increase an existing, or impose a new telecommunications occupation tax before 2018, the issue must be voted on by the people of that municipality.

LB562 Cornett Revenue Committee - Change provisions relating to license and occupation taxes imposed by municipalities. LB 562 is being introduced to limit municipal occupation tax rates for all cities and villages in Nebraska for purposes of regulating intrastate commerce, interstate commerce, and foreign commerce. Imposition of municipal occupation taxes is a matter of statewide concern, not merely a matter of local concern. Therefore, LB 562 is an important bill and its subject matter is appropriate for legislative action.

LB465 Campbell Health & Human Services Committee. Eliminate provisions relating to eligibility of non-United-States citizens for public assistance. LB 465, introduced at the request of the Governor, is a part of the Governor's biennial budget recommendations. This bill eliminates the state-only coverage for legal permanent residents in the following programs: Medicaid, Aid to Dependent Children (ADC), Assistance to the Aged, Blind and Disabled (AABD) and State Nutrition Assistance Program (SNAP). Legal permanent residents are not eligible for assistance in these programs until they have resided in this country for five years. The state covers this population with general funds. The savings per program is listed below. The savings are annual figures.

LB467 Campbell Health & Human Services Committee. Change eligibility provisions relating to the medical assistance program. This bill would eliminate Medicaid coverage for an adult member of a family receiving Aid to Dependent Children assistance if the adult fails to fulfill required work requirements under the Employment First program. Pregnant women and women in the 60-day postpartum period are exempt from the Employment First Medicaid sanction. There are approximately 925 persons on an Employment First sanction each month. The average monthly cost is $341 per person. The total annual cost is $3,800,000 ($1,600,000 GF and $2,200,000 FF) each year.

LB 408 Fulton - Do NOT advance LB 408. The state should not require 6 months of counseling for individuals who have filed for divorce. The majority of cases must be in the category of complete agreement on divorce by the time they file. The expense of counseling may cause an unnecessary hardship on one or both of the individuals. The couple is already incurring expenses for two residences, two sets of utilities, etc...plus attorney fees. I can see this bill causing both financial and emotional hardship.

LB488 Nordquist - Do NOT advance LB 488. From hearing "horror" stories about tactics used in collecting child support. I can only assume that this bill's intention is to embarrass the non-custodial parent. I guess it is not enough that a non-custodial parent is, in many cases, treated as dung on the bottom of one's shoe; or having visitation withheld by the custodial parent without penalty; or in some cases, the non-custodial parents relationship alienated from the child(ren) by the custodial parent without penalty. If Senator Nordquist wants to save NE a lot of money he should create a website to post pictures and information of illegal aliens in our state.

LB147 Hadley - Advance LB 147 with a minor change. In section (6) post secondary education financial responsibility by the parents is ages 19 - 23. Please consider the fairness of making the ages between 19 - 21. That allows the adult "child" two years of college experience and should be able to finance their own college education from that point. Let me commend our legislators on the enactment of the original bill that attempts to standardize so many inflammatory issues couples with children go through. This bill establishes non-custodial parents some form of basic protections from an uncooperative custodial parent. If there are no penalty provisions in cases where the custodial parent withholds visitation or attempts to alienate the child(ren) from the non-custodial parent - you may want to consider including that in this bill too.

Currently, no funding exists for the Agricultural Opportunities and Value-Added Partnership Cash Fund. If the intent of LB 200 is to reduce funding for the Agricultural Opportunities and Value-Added Partnership program by $100,000 in FY11-12 and FY12-13, then the General Fund budget for the program (currently established at $850,000) would be reduced by $100,000 in both FY11-12 and FY12-13, and the General Fund would be source of revenue for transfers into the Nebraska Healthy Food Financing Initiative Cash Fund. The Rural Development Commission would incur $60,000 in contractual expenses in FY11-12 to finance the University of Nebraska research study. The agency also estimates that there would be $4,000 in annual additional administrative costs to carry out the act. Assuming that General Funds were transferred into the Nebraska Healthy Food Financing Initiative Cash Fund, costs would be paid from the cash fund. It is estimated that the $36,000 not expended for research and administrative costs in FY11-12 and the $96,000 not spent for administrative costs in FY12-13 could be applied to grants for project financing

LB126: Please do NOT advance LB126. I appreciate the concern by Sen Avery about obese children. However, the decision lies with the parent(s) as to what and how much their children eat. It is unreasonable to place our state in the role of making decisions for the parents and the food industry.

LB 200: Please do NOT advance LB 200. This bill is going to require money from the General Fund - which I believe is funded by the taxpayers. Why would we offer financing to company's to expand or for new construction of restaurants or grocery stores simply because they agree to use fruits and vegetables on their menus? This bill does spend money - and it's money that is being unnecesarily spent. The education of "fresh fruit/vegetables/healthy eating" by schools should be enough - atleast I have to assume that when my 6 year old nephew worries about "putting only healthy things in his mouth."

LB584 Fulton Transportation & Telecommunications Committee - Exempt deployed military personnel from motor vehicle registration fees. Allows additional flexibility for Nebraska's soldiers deployed overseas, granting them the ability to register their motor vehicles and trailers, and pay the corresponding registration fees, for the period in which their vehicles or trailers are actually in use.

LB327: Please do NOT advance LB 327. It doesn't seem like a fee of $10 per aged (14 + yrs) vechicle should be an issue but it is for those who are on a limited income.  While I appreciate the creativity of our lawmakers to raise revenue - this is just one more fee that will increase over the years. One of the reasons people drive 14+ aged vehicles is to keep the insurance and licensing costs down. But it just doesn't seem to matter what citizens try to do to live within their means the state will find a way to create new or increase existing costs/fees. So, it really isn't the $10 - it's the principle.
